Terms of Use

These terms cover your use of this website and the AI Readiness Self-Scan. They are deliberately short. They do not govern paid work — that runs on a signed agreement, and section 06 explains the shape of it.

01Who these terms are with

This website is operated by Herculean Path Ventures, LLC, a New York limited liability company, at 2806 US 11, LaFayette, NY 13084 ("HPV", "we", "us"). Using the site means you accept these terms. If you do not, please do not use it.

02What the self-scan is — and is not

The AI Readiness Self-Scan is an indicative self-assessment. It scores answers you supply about your own business, using a fixed weighting, and returns a composite, a level band and a per-dimension breakdown. Everything it tells you is derived from what you typed.

It is not an audit, a professional opinion, or advice — legal, financial, technical or otherwise. It does not inspect your systems, verify anything, or know anything about your business that you did not enter. Do not make an investment, staffing or compliance decision on the strength of a score out of 100. Getting a real answer is what a paid engagement is for.

We make no representation that the model, weightings or bands are suitable for your circumstances, and we may change them at any time. Two people answering identically today and next month may see different guidance.

03Emails you receive

Submitting the self-scan form asks us to email you. You will receive your results immediately, and two short follow-up emails over the following week. Both follow-ups are marketing and both carry an unsubscribe link; use it and the remaining scheduled emails are cancelled. What we do with the information you submit is set out in the Privacy Policy.

The text, design, motion, diagrams, the nine-control governance framework, the self-scan model and its copy are owned by HPV and protected by copyright. You may read, print and share pages for your own evaluation. You may not reproduce them commercially, or present them as your own, without our written permission. Our name, logo and "Strength Through Strategy, Success Through Resilience" are our marks.

06Engagements are contracted separately

Nothing on this website is an offer capable of acceptance, a quotation, or a commitment to perform work. Descriptions of the three tiers are summaries, not terms.

Paid work is governed exclusively by a written agreement signed by both parties, with a statement of work describing scope, fees, timing, deliverables, ownership and termination for that specific engagement. Where anything on this site differs from a signed agreement, the signed agreement controls.

07Third-party links and services

The site links to third parties, including our scheduling page at Calendly. We do not control them and are not responsible for their content, availability or privacy practices. Their own terms apply when you use them.

08Availability

We provide the site "as is" and "as available", without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that it will be uninterrupted, error-free, or that its content is accurate or current. We may change or withdraw any part of it at any time.

09Limitation of liability

To the fullest extent permitted by law, HPV is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunity, arising from your use of this website or reliance on the self-scan. Our total aggregate liability arising from the website or the self-scan will not exceed one hundred US dollars ($100). Nothing here limits liability that cannot lawfully be limited. This section does not apply to paid engagements, whose liability terms are set in the signed agreement.

10Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute arising from the website or these terms will be brought exclusively in the state or federal courts located in Onondaga County, New York, and you and we each consent to their jurisdiction.

11Changes

We may update these terms; the date at the top will change when we do. Continuing to use the site after an update means you accept the revised version.
